Trying to understand the controller can be a more confusing matter. Generally, it falls under the jurisdiction of the FDA. Because of the long-standing neglect of Kratom, they took the decision to local and state officials.

As with marijuana policy here in the United States, the answer to our question can be confusing. Some states/territories have laws regarding their consumption, some have administrative policies, and others ban kratom altogether.

The short answer to our impatient readers is kratom legal in Florida? Yes, about 99%. But you can stay tuned for our detailed answers, especially if you live in Sarasota County.

We explained that kratom is legal in 99% of Florida. Hi, welcome to the other 1% (about 1.5% if we’re being technical).

In January 2014, Sarasota County passed a county ordinance making it illegal to possess kratom in any form. The county has classified kratom as a “scheduled drug” under Title XIII of the Sarasota County Code.

When purchased from a reputable source, kratom is a natural, unadulterated product. No harmful additives or ingredients of any kind.

This classification of kratom misrepresents kratom as designer drugs like cannabinoids (also known as K2 or spice) or bath salts.

However, possession of kratom in Sarasota County is punishable by up to 60 days in jail and/or a $500 fine. Court attendance is also mandatory. So there is no immediate message to deal with criminals in the province.

Efforts to ban or regulate kratom in Florida have met with limited success, but not without effort.

What Law Enforcement Needs To Know About Kratom

In 2019, the St. Johns County Board of Commissioners is considering banning the sale of kratom in the county. After 19 people testified before the board about their right to use kratom, the commission decided to move the state to regulate the plant. Sarasota remains the only county in Florida where the sale and possession of kratom in any form is prohibited.

Instead of outright banning kratom, the percentage of controlled sales and possession of kratom in Florida is increasing. Although little progress has been made in terms of regulation, several bills have been proposed to implement the Florida Kratom Consumer Protection Act (KCPA).

The Florida Kratom Consumer Protection Act refers to regulations governing the production and sale of kratom.

However, this concept is not new. States such as Arizona, Georgia, Oklahoma, Nevada, and Utah have already passed KCPA bills, all of which provide the same regulatory framework.

This KCPA Bill aims to achieve the same objective in all states. quality control and proper use of kratom; In addition to protecting the individual rights of Americans to responsibly process and use kratom.

Some states, like Colorado and Missouri (and many others), are considering similar bills as we speak. While there are several proposals for establishing a Florida KCPA, we will focus on the most recent.

The latest attempt to create the Florida KCPA is Senate Bill 1076. The bill, proposed by Senator Joe Grueters on 11/30/2022, aims to establish guidelines for processing and selling kratom.

Section 501. In Section 1 of Section 9745, the bill sets forth several restrictions related to the processing of kratom. (Please note that some parts of the project are detailed and not intended as legal guidance)

A Sensible, Evidence Based Proposal For Kratom Reform

According to the bill, a manufacturer cannot sell, prepare, distribute or display kratom products:

Also, paragraph one (3), Senate Bill 1076 specifies who is authorized to sell kratom. The agency “may not sell, distribute, or sell kratom to anyone under the age of 21.”

In the end, Senate Bill 1076 failed to appear and died in appropriations on 03/14/2021, despite being supported by the Appropriations Committee 10-0.

Although the bill failed to pass, this is the furthest the Florida KCPA will get in the Florida Senate. A sign of hope for deregulation supporters.

Kratom, An Addict’s Alternative, Is Found To Be Addictive Itself

A bill with similar language was introduced in the House a month later. House Bill 1071, introduced by Alex Andrade, died in the Law Reform Committee the same day as SB 1076.

In June 2023, Governor Ron DeSantis signed the Kratom Consumer Protection Act into law. Receipt is blank and valid only for the age limit for selling kratom products: 21+.

Why do kratom advocates care about regulating it? Fewer regulations = more products for more people, right?

Here at Top Tree we are all about kratom and we believe it should be available to all eligible adults. Bottom line, we care about regulations because we care about kratom.

Florida Bill Would Impose Some Restrictions On Kratom

Dr. Take one of these studies done. Oliver Grundman in 2020. Grundman’s research analyzed kratom products purchased from stores in the Chicago area.

Research by Grundman and his colleagues has shown that some of these samples contain unsafe levels of heavy metals (lead, nickel) and microorganisms.
