Last year, New York became the first state to restrict cryptocurrency mining based on energy consumption. Lawmakers approved a two-year moratorium on new mining projects that use electricity obtained directly from fossil fuel companies. The bill was drafted in response to mining companies redeveloping aging coal and gas facilities to improve their operations.

The White House said the rapid growth of the industry “could hinder larger efforts to meet America’s climate commitments to achieve non-zero emissions.”
Missouri Representative Phil Cristofanelli, a Republican, told Stateline, “We must now fly the flag as a nation in support of cryptocurrencies.” “It will continue to grow and we want Missouri to open up and embrace new types of innovation and industries.”
Christofanelli proposed a “mining rights” law that would prohibit local governments from restricting cryptocurrency mining. The bill also exempts cryptocurrencies from property taxes and says that digital currencies do not require the same licenses that banks require.
The bill that passed the committee earlier this month is similar to bills approved this year in Montana and Mississippi. A Montana bill that passed the state Senate last month and is awaiting a House hearing would impose zoning restrictions on cryptocurrency miners. It would also direct public utility companies to supply miners with electricity consistent with other industrial customers.

“We just want to make sure the laws are known and fair. So if businesses want to invest in Montana, they need to know what those laws are,” the state senator said. While some see the economic potential of cryptocurrencies as promising, others believe their growth could hinder the state’s ability to meet its clean energy goals.
“There are too many green electrons now,” said Mandy DeRoche, deputy attorney general for clean energy at Earthjustice, a nonprofit environmental law group. “You can’t hit aerial targets with that much weight.”
DeRoche raised concerns about electricity costs in areas where new infrastructure is being built to meet cryptocurrency mining requirements, adding that the projects the company has created rarely fulfill their original promises.

But the company’s supporters say their work can be a benefit, not a liability, to the power grid. They say cryptocurrency mining operations will create demand that will help developers build wind and solar energy, creating a large “off-take” for that energy at a time when generation is greater than what homes and businesses need.
“This is another financial incentive for these companies, so they are motivated to expand clean energy,” said Tom Mapes, director of energy policy at the Chamber of Digital Commerce, a blockchain advocacy group. “In areas with more energy, this really makes sense.”
Mapes recognized the “criminals” who gave cryptocurrency mining a bad reputation and said that only a small number of miners want to use repurposed fuel. He said questions about the use of cryptocurrencies as a financial instrument have sparked efforts to limit mining, raising suspicions that other energy companies are not paying attention.
“There are some politicians who don’t like this technology and see it as a nuisance rather than a help,” he said. “If there’s a way to fight this technology now, it’s the use of violence.” .

One of the lawmakers involved in the debate is a member of the Oregon House of Representatives. Pam Marsh (Democrat). Oregon’s clean energy law applies to utility owners, which cover about 75% of the state’s population. Marsh has supported legislation that would require cryptocurrency miners and data centers to purchase energy from other companies, such as public utilities and the electric sector, to meet clean power goals.
“One large data center can use as much energy as 80,000 buildings,” he said. “These are outsiders, and they should be forced to compromise their power in the same way they would be in the [company owner’s] realm.”
Marsh added questions about the “authenticity” of cryptocurrencies as financial products, adding to concerns about whether cryptocurrencies can be used properly. The bill is scheduled for consideration this week in the Climate, Energy and Environment Committee.
Washington state legislators are considering such a bill. Currently, customers who purchase electricity from wholesalers or retailers through their local utility are subject to the state’s clean power requirements only if they are in a district owned by the investor. The bill would expand the rules for consumer-owned utilities, which sell about half of Washington’s electricity.

Although the bill does not specifically mention cryptocurrency mining, the growth of the industry is one of the reasons state leaders agreed to introduce the plan. Glenn Blackman, energy policy manager for the state Department of Commerce, said cryptocurrency projects are necessary in Pend Oreille County, which plans to buy energy outside the city’s public utility district, and asked if the energy imports will be repeated.
“We believe the amount of electricity used in our state will double in the next few decades,” Blackmon said. “All growth will come from renewable sources, and that requires a lot of money to invest. Adding cryptocurrencies to that has the potential to make a ton of money.
